Terms of Service

1. Acceptance of Terms

By accessing or using the AsidePocket application and website ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

AsidePocket provides a private messaging application featuring a camouflage shell interface. We provide both free and paid ("Premium") tiers. We reserve the right to modify or discontinue, temporarily or permanently, the Service with or without notice.

3. User Responsibilities

You agree to use the Service only for lawful purposes. You are strictly prohibited from using AsidePocket to:

• Engage in illegal activities or promote illegal acts.
• Harass, abuse, or harm another person.
• Distribute malware, viruses, or any other malicious code.
• Attempt to bypass or exploit our security measures.

We reserve the right to terminate accounts that violate these guidelines. Termination does not create an automatic refund; support may review a billing or payment issue under the applicable payment terms.

4. Subscriptions and Payments

Premium features require a paid subscription. By selecting a Premium plan, you agree to pay AsidePocket the monthly or annual subscription fees indicated for that service.

Payments will be charged on a pre-pay basis on the day you sign up and will cover the use of that service for a monthly or annual subscription period as indicated. We generally do not issue prorated refunds for partial months, but support can review billing errors and refund requests under the applicable payment terms.

Billing descriptor: A payment processor descriptor will appear on your bank or card statement. We do not publish the exact descriptor on this public site; banks and card issuers may shorten or format it differently.

Connections: Free accounts include two lifetime unique connections. A connection is counted only when a new relationship is successfully established, regardless of which person sent the request. For a new relationship, both people must have available capacity unless they have active Premium. Sending, ignoring, cancelling, blocking, or failing to complete a request does not consume connection capacity. Previously established pairs can reconnect without using another connection.

Each $5.99 connection credit adds capacity for one additional unique connection. It is a one-time, non-recurring purchase, never expires, and persists across devices and subscriptions. Included Free capacity is used before purchased capacity. Premium provides unlimited new connections while active, subject to anti-abuse controls; while active, Premium bypasses Free and purchased capacity. Existing connections remain available if Premium later ends, and unused purchased credits remain available.

Refunds are not guaranteed by these Terms. Contact support with the relevant account and payment details for a billing-error or refund review. If a purchased credit is refunded before use, the unused credit is reversed. A refund after that credit was consumed does not undo an established connection or create a negative credit balance.

5. Account Security and PIN

You are entirely responsible for maintaining the confidentiality of your PIN and for any and all activities that occur under your account. AsidePocket does not store your PIN itself. You may optionally configure a personal recovery question, hint, and answer in the app. If recovery is configured, you can use the answer to choose a new PIN; recovery answers are normalized for case-insensitive matching and stored as one-way cryptographic hashes. You should choose an answer only you would know and a hint that does not reveal it. If you lose your PIN without configuring recovery, you may lose access to your local data.

6. Account Deletion

You can permanently delete your account from the app's Settings. Deletion removes active AsidePocket profile data, contacts, connection requests, conversations, messages, Events you created, tracked uploads, notification subscriptions, and the related sign-in identity. Any active AsidePocket subscription is cancelled immediately. Stripe may retain transaction and invoice records for accounting, fraud prevention, dispute handling, and legal compliance. Safety reports may be retained after database links to your deleted profile and conversations are removed; report text may retain details another person included.

7. Limitation of Liability

In no event shall AsidePocket, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
